Terms of Service

These Terms of Service ("Terms") govern your access to and use of FurPaws (the "App"), operated by Prolistify LLC ("Prolistify," "we," "us," or "our"). By installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent that you meet this minimum age requirement. If you are under 18, you represent that you have your parent or legal guardian's permission to use the App and to agree to these Terms on their behalf.

2. Account creation and security

Some features of the App require you to sign in using a third-party authentication provider (Google or Apple). You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activity that occurs under your account.
• Notifying us promptly at support@furpaws.app if you suspect unauthorized access.

We may suspend or terminate accounts that violate these Terms, engage in abuse, or pose a security risk.

3. Subscriptions and purchases

3.1 Pro subscription

The App offers an optional paid subscription ("Pro") that unlocks additional features such as unlimited scans, the AI Coach, and other features as described in the App at the time of purchase.

3.2 Pricing and billing

• Subscription prices are displayed in the App at the time of purchase.
• Purchases are processed by Apple App Store (on iOS) or Google Play (on Android), not by Prolistify directly.
• Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the period ends.
• Renewals are charged to the payment method associated with your Apple or Google account.

3.3 Cancellation

You can cancel a subscription at any time:

• iOS: Settings → [Your Name] → Subscriptions → FurPaws → Cancel
• Android: Google Play → Profile → Payments and subscriptions → Subscriptions → FurPaws → Cancel

Cancellation takes effect at the end of the current billing period. You will retain access to Pro features until that period ends.

3.4 Refunds

Refund requests are handled by Apple or Google according to their policies, not by Prolistify. We do not have the ability to issue refunds directly through the App.

3.5 Free trial (if offered)

If a free trial is offered with the Pro subscription:

• The trial period and any required payment information will be disclosed at sign-up.
• The subscription will automatically convert to a paid subscription at the end of the trial unless canceled before then.
• Only one free trial is available per Apple ID or Google account.

3.6 Price changes

We may change subscription prices for new subscribers at any time. For existing subscribers, any price increase will take effect on the next renewal after we provide notice. Apple and Google handle their respective price-change notifications per their policies.

4. The App and its features

4.1 What the App does

FurPaws helps you identify pet breeds, track health observations, and access pet-care guidance through an AI Coach. Features include:

• Breed identification from photos.
• Breed-specific health watchlists.
• Comparative scan analysis between two photos of the same pet.
• Conversational AI Coach (Pro only).
• Pet profile management and scan history.

4.2 Important: Not veterinary advice

FurPaws is not a veterinary service. Information provided by the App, including breed identifications, health observations, watchlists, and AI Coach responses, is for general informational and educational purposes only. It is not a substitute for professional veterinary diagnosis, treatment, or advice.

Always consult a licensed veterinarian for:

• Medical concerns about your pet.
• Diagnosis of illness or injury.
• Treatment decisions.
• Emergency situations.

The App may produce inaccurate, incomplete, or misleading results. AI-generated content can include errors, hallucinations, or outdated information. You should verify any health-related guidance with a qualified professional.

In emergencies, contact a veterinarian or emergency animal hospital immediately. Do not rely on the App.

4.3 Service availability

We strive to keep the App available but do not guarantee uninterrupted access. Features depend on third-party services (Apple, Google, Anthropic, etc.) that may experience outages outside our control. We may modify, suspend, or discontinue features at any time without liability.

4.4 Usage limits

Free users may scan up to 10 pets over the lifetime of their account. Pro subscribers have higher limits. The App may apply additional rate limits to prevent abuse, including limits on how many AI requests can be made in a given period. Specific limits may change.

5. Acceptable use

You agree NOT to use the App to:

• Violate any law or regulation.
• Infringe on the intellectual property, privacy, or other rights of others.
• Upload content that is illegal, harmful, abusive, harassing, or sexually explicit.
• Upload photos of human beings (the App is for pets).
• Attempt to reverse-engineer, decompile, or extract source code from the App, except as permitted by applicable law.
• Use automated tools, bots, or scripts to access the App or generate scan requests.
• Resell, redistribute, or commercially exploit the App or its outputs.
• Circumvent rate limits, paywalls, or other technical restrictions.
• Misrepresent your identity or impersonate others.

We may suspend or terminate your access for any violation of these rules, with or without notice.

6. Your content

6.1 Ownership

You retain ownership of content you upload (pet photos, names, notes, messages). We do not claim ownership of your content.

6.2 License to us

By uploading content, you grant Prolistify a limited, worldwide, non-exclusive, royalty-free license to use, store, process, and display that content solely for the purpose of operating and improving the App and providing you the requested features. This license ends when you delete the content or your account, except for content already shared in ways that cannot be undone (such as service-provider logs retained per Section 7 of our Privacy Policy).

6.3 Your responsibility

You represent that:

• You own or have the right to use any content you upload.
• Your content does not violate any law or third-party rights.
• Your content does not include images of identifiable humans without their permission.

7. Intellectual property

The App, including its design, code, branding, logos, and original content, is owned by Prolistify LLC and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works of the App without our express written permission.

"FurPaws" and the FurPaws logo are trademarks of Prolistify LLC.

8. Third-party services

The App relies on third-party services including but not limited to: Apple, Google (Firebase, Cloud Functions, Cloud Storage, Play Billing), Anthropic, RevenueCat, and PostHog. Your use of features that rely on these services is also subject to their respective terms and policies.

9. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION:

• WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
• WARRANTIES THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
• WARRANTIES THAT BREED IDENTIFICATIONS, HEALTH OBSERVATIONS, OR AI COACH RESPONSES ARE ACCURATE, COMPLETE, OR RELIABLE.

You use the App at your own risk. Do not make medical, financial, or other significant decisions based solely on App outputs.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROLISTIFY LLC AND ITS OWNERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES.
• LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION.
• HARM TO YOUR PET ARISING FROM RELIANCE ON APP OUTPUTS RATHER THAN VETERINARY ADVICE.
• DAMAGES EXCEEDING THE GREATER OF (a) THE AMOUNT YOU PAID PROLISTIFY IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (b) FIFTY US DOLLARS ($50).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the smallest extent permitted by law.

11. Indemnification

You agree to defend, indemnify, and hold harmless Prolistify LLC and its owners, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising from:

• Your use or misuse of the App.
• Your violation of these Terms.
• Your violation of any third-party rights, including intellectual property or privacy rights.
• Content you upload to the App.

12. Termination

You may stop using the App and delete your account at any time. We may suspend or terminate your access if you violate these Terms or for any other reason at our sole discretion. Upon termination:

• Your right to use the App ends immediately.
• Sections of these Terms that by their nature should survive (e.g., disclaimers, limitation of liability, governing law) will continue to apply.

13. Governing law and disputes

These Terms are governed by the laws of the State of Louisiana, United States, without regard to conflict-of-law principles.

13.1 Informal resolution

Before filing any formal dispute, you agree to first contact us at support@furpaws.app to attempt to resolve the issue informally. We will work in good faith to resolve disputes within 60 days of notice.

13.2 Forum

If informal resolution fails, any legal action must be brought in the state or federal courts located in Louisiana, and you consent to personal jurisdiction in those courts.

13.3 No class actions

You agree to bring any dispute on an individual basis only. You waive the right to participate in a class action, collective action, or representative proceeding against us, to the extent permitted by law.

13.4 Time limit

Any claim arising from your use of the App must be brought within one (1) year of the event giving rise to the claim, or it will be permanently barred.

14. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will:

• Update the "Last updated" date at the top of this page.
• Notify you in the App or by email if the changes significantly affect your rights or obligations.
• Provide reasonable advance notice before changes take effect.

Your continued use of the App after changes take effect constitutes acceptance of the new Terms. If you do not agree to the changes, your sole remedy is to stop using the App and cancel any active subscription.

15. Miscellaneous

• Severability. If any part of these Terms is found unenforceable, the rest remains in effect.
• No waiver. Our failure to enforce any right is not a waiver of that right.
• No assignment. You may not transfer your rights under these Terms without our written consent. We may assign our rights and obligations under these Terms.
• Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Prolistify regarding the App.
• No agency. No partnership, joint venture, or agency relationship is created by these Terms.
